In accordance with Art. 13 of Regulation (EU) 2016/679 (“Privacy Regulation”), Elica S.p.A. wishes to inform you and all users and/or visitors of the website www.elicaclub.com, a web platform intended for shops and dealers of “Elica”-branded products (“Users” and the “Website”, respectively), about the use of personal data, log files and cookies collected via the said Website.

This Policy also relates to data processing for marketing purposes carried out within the website elica.com, which may be performed, subject to the user's consent, by Elica S.p.A., with registered office at Via Ermanno Casoli 2, 60044 Fabriano (AN), Italy, tax code and business registry no. AN 00096570429, fully paid-up corporate capital 12,664,560 euros, tel. +39 0732 610 1, fax +39 0732 610 249, (hereinafter referred to as “ELICA”).

  1. Information automatically collected by the Website - Cookies

a) Information collected automatically

Like all websites, our Website uses log files which store information collected automatically during your visits. Indeed, the computer systems and software procedures used to operate this Website automatically acquire, during use, certain information whose transmission is implicit in the use of Internet communication protocols.

The information collected is as follows:

  • Internet Protocol (IP) address or domain name of the device used by you;
  • browser type and parameters of the device used to connect to the Website;
  • the URI (Uniform Resource Identifier) addresses of the requested resources or the method used to send the request to the server;
  • name of the Internet Service Provider (ISP);
  • date and time of visit;
  • User's web page of origin (referral) and exit page;
  • number of clicks, if applicable;
  • size of the file obtained in response;
  • numeric code indicating the status of the data response from the server (successful outcome, error, etc.);
  • other parameters relating to your device’s operating system and computer environment.

This information is processed automatically and collected exclusively in aggregate form in order to verify correct functionality of the Website.

b) Cookies

The Website uses cookies. Cookies are text files, stored in electronic form, used to record certain parameters and data communicated to the computer system through the browser used by you. These tools therefore permit analysis of your habits with regard to use of the Website, for various purposes: performance of digital authentication, monitoring of sessions, storing of information on specific configurations regarding users who access the server, storage of preferences, etc.

  1. Technical cookies: used for browsing or to provide a service requested by you. Without use of these cookies, some operations could not be completed or would be more complex and/or less secure.

Through use of the Website, the use of cookies is considered to be accepted and you consent to processing of data collected by Third Parties.

  1. The personal data you give us by using the Website: what we process it for.

We use your data to enable you, using the Website, to:

  1. Receive e-mail updates regarding all our promotional and marketing initiatives, including direct marketing, such as but not limited to information relating to our latest collections and to events and advertising campaigns organised by the Data Controller (the “Newsletter”);
  2. Register for prize competitions, draws and free gifts available exclusively to showroom sales personnel (“SSP”) of shops and dealers marketing “Elica”-branded products;
  3. Participate in the loyalty programme exclusively for SSP;
  4. Participate in training courses exclusively for SSP.

Your personal data is processed for the following purposes:

  i.                  to fulfil legal obligations;

ii.                  to enable you to register with the Website;

iii.                  to provide you with the Newsletter service by sending you exclusive promotions, offers and discounts;

iv.                  fulfilment of contractual obligations (registration for prize competitions, draws and free gifts, participation in loyalty programmes, and training).

Personal data processing for the above purposes will be performed in accordance with the Privacy Regulation and all industry-specific regulations, including the provisions of the “Italian Data Protection Authority Regulations on Personal Data Processing for Online Profiling” of 24 February 2005 and the “Guidelines on Personal Data Processing for Online Profiling” of 19 March 2015.

In accordance with the “Guidelines on Promotional Activities and Combating Spam” of 4 July 2013, please note that any consent given by you to the sending of sales, promotional and marketing communications using automated tools will also extend to traditional forms of contact.

Your data will be processed mainly by electronic means, under the authority of the Data Controller, by subjects specifically authorised and trained on processing pursuant to Art.s 28 and 29 of the Privacy Regulation and Art. 2) of the Italian Privacy Code as amended by Italian Legislative Decree 101/2018. We inform you that appropriate security measures are also observed, pursuant to Art.s 5 and 32 of the Privacy Regulation, to prevent data loss, illegal or incorrect use and unauthorised access.

  1. Mandatory or optional nature of consent for the provision of data, consequences of any refusal and legal basis for processing

Please be advised that, for the purposes of points (i), (ii) and (iv) of paragraph 3, above, provision of your personal data is mandatory since failure to provide it would prevent you from using the Services indicated in paragraph 3, letters b), c) and d).

Provision of your personal data is not mandatory but optional for the purposes of point (iii) of paragraph 3, above. Failure to provide the data for the above-mentioned purposes would prevent us from supplying you with the Newsletter. To this end, you are free to decide whether or not to give your consent also for these purposes, and this will not affect your ability to access the Website Services.

Please remember that you can ask the Data Controller to delete your data, in any case and at any time, by means of simple notice sent with no special formalities to the e-mail addresses indicated in paragraph 1, above.

With regard to the purposes indicated in points (i), (ii) and (iv) of paragraph 3, above, the legal basis for processing is performance of the services provided through the Website and requested by you (pursuant to Art. 6, paragraph 1, letter b) of the Privacy Regulation). With regard to the purposes indicated in point (iii) of paragraph 3, above, the legal basis for processing is any consent freely expressed by you (pursuant to Art. 6, paragraph 1, letter a) of the Privacy Regulation).

  1. To whom and in what context we may transmit your data

Your data may be communicated, within the EU and in full compliance with the provisions of the Italian Privacy Code and the Privacy Regulation, to the following subjects:

(i) the tax authorities and/or other public authorities, where this is required by law or at their request;

 (iii) entities, subjects and external companies, designated as Data Processors and authorised to process the data, used by the Data Controller to conduct activities connected, instrumental or consequent to performance of the Website Services - including the cloud computing storage service - and to sending of the Newsletter;

  1. Your rights

Please remember that you can exercise the rights pursuant to Art.s 15, 16, 17, 18, 20 and 21 of the Privacy Regulation at any time by sending a written notice to the e-mail addresses of the Data Controller and/or the DPO as indicated in paragraph 1, above, and, consequently, obtain:

  • confirmation of the existence or otherwise of your personal data and its origin, verify its accuracy or request to have it updated, amended and/or supplemented;
  • access to or rectification or erasure of the data, or restriction of processing;
  • deletion, transformation to anonymous form or blocking of unlawfully processed data.

In addition, you can object to processing of data concerning you.

With regard to the Newsletter, please note that your right to request cessation of processing carried out by automated contact methods also extends to traditional ones. Moreover, you maintain the option to partially exercise this right by requesting interruption, for instance, of promotional communications via one or more of the contact methods for which you have given consent.

The above-mentioned rights can be exercised by means of a request, including through a representative, sent directly to the Data Controller in the form of a written notice to the Elica addresses indicated in paragraph 1 or to the Data Protection Officer at the e-mail address privacy@elica.com.  The form for exercise of rights is available on the Italian Data Protection Authority’s website at the web address:

  1. Duration of processing

Without prejudice to the legal obligations, personal data will be stored for a given period of time, determined according to the nature of the services provided and the legal obligations arising from the applicable legislation (management of competitions and prize draws, for instance).  Please note that data stored for marketing purposes (necessary for the Newsletter service) will be stored and may be used until the data subject requests deletion (or exclusion from the service), exercising the rights under current legislation.

  1. Security Measures

Through the Website, your data is processed in accordance with applicable law and using appropriate security measures in accordance with current legislation, also pursuant to Art.s 5 and 32 of the Privacy Regulation.

In this regard, we confirm, among other things, the adoption of appropriate security measures designed to prevent unauthorised access, theft, disclosure, modification or unauthorised destruction of your data.

  1. Amendments to the Privacy Policy

The Data Controller reserves the right to amend this Privacy Policy. In this case, you will be promptly notified the next time you use the Website.
